aria-controls='tab-id-1-content'  itemprop=\"headline\" >Title I<\/div><div id='tab-id-1-content' class='tab_content active_tab_content' role='tabpanel' aria-labelledby='tab-id-1-tab' aria-hidden=\"false\"><div class='tab_inner_content invers-color'  itemprop=\"text\" ><h3>General Principles <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/h3>\n<h4>Art. 1 - Nature, role and purpose of the Conservatoire<\/h4>\n<ol>\n<li>The \u201cG. Verdi\u201d Conservatoire of Music in Milan, hereinafter referred to as the Conservatoire, is a public institution of higher musical education endowed with legal personality, as provided for by Article 1 of Law no. 508 of 21 December 1999. The Conservatory, through the performance of teaching, research, production and service activities, pursues the purposes of study, elaboration, development and dissemination of musical culture, creation and practice.<\/li>\n<li>According to the modalities that are the subject of the regulations as per letters g) and h) of paragraph 7 of art. 2 of the above-mentioned law no. 508\/99, the Conservatoire establishes and activates basic training courses, first-level academic diploma, second-level academic diploma, specialisation courses, research training courses and specialisation or master's degree courses and awards specific first- and second-level diplomas, specialisation academic diplomas, research training academic diplomas in the field of music and specialisation or master's degrees. It also institutes and runs, until new legislative provisions, courses according to the programmes and modalities of the system prior to Law no. 508\/99.<\/li>\n<li>The Conservatoire awards the qualifications listed in the annex to the Education Regulations.<\/li>\n<li>The Conservatory in accordance with Article 33 of the Italian Constitution and Law 508\/99 and subsequent amendments:<br \/>\n(a) it has statutory, teaching, scientific, administrative, financial and accounting autonomy, also by way of derogation from the rules of the State and public bodies, but in compliance with the relevant principles;<br \/>\n(b) affirms in all its actions its pluralistic character, independent of conditioning of any kind, and promotes actions that favour the overcoming of any kind of discrimination;<br \/>\n(c) inspire its action by the democratic method, guaranteeing the widest participation and transparency of decision-making processes and ensuring publicity for all resulting acts;<br \/>\n(d) value the skills, experience, abilities and commitment of those working in its structures;<br \/>\ne) it bases its activities on criteria of efficiency and effectiveness, through the instruments of programming by objectives and quality assessment;<br \/>\nf) it guarantees the application of the rules for the right to study and organises its teaching, support and guidance services in such a way as to make the study itself effective and profitable; it takes the appropriate initiatives, also in collaboration with other subjects, in order to orient and favour the insertion of its graduates and specialists in the world of work; it favours, within the framework of its international vocation, cultural exchanges and the mobility of teachers and students;<br \/>\ng) in compliance with the principles set out in Article 2(8)(d) of Law No. 508\/99, it encourages, also at institutional level, any initiative aimed at extending and improving basic musical training and propaedeutic training for the courses governed by this Statute, as well as any initiative, including continuing and refresher training, aimed at extending and improving the musical public;<br \/>\nh) In order to achieve its aims, the Conservatoire is open to collaboration, by means of agreements or conventions, with any other institution of the same degree, or of a different degree and type, in Italy and abroad, and in particular with AFAM (Polytechnic of the Arts) or inter-conservatory institutions.<\/li>\n<li>The Conservatoire ensures the conservation, enhancement and enrichment of the heritage in its possession.<\/li>\n<\/ol>\n<h4>Article 2 - Freedom of teaching and research<\/h4>\n<ol>\n<li>The Conservatoire guarantees individual teachers and the teaching, production and research structures full freedom and autonomy. To this end, it guarantees access to funding and the use of infrastructures and technical equipment in accordance with the law and internal regulations.<\/li>\n<li>The Conservatoire annually allocates, to the extent permitted by the resources available in its budget and after having fulfilled its teaching and production tasks, a portion of its budget resources to the teaching structures for the development and enhancement of research in the field of music.<\/li>\n<\/ol>\n<h4>Article 3 - Freedom of assembly and use of space<\/h4>\n<ol>\n<li>The Conservatoire guarantees freedom of assembly in its spaces to internal members for cultural, trade union or other reasons related to the life of the Conservatoire, in accordance with the procedures laid down in the internal regulations.<\/li>\n<li>The Conservatoire encourages the holding of congresses, conferences and production initiatives in the field of music. The use of spaces for such activities, or at the request of external parties, is permitted on the basis of internal regulations dictated by the Board of Directors, in correspondence with established needs that do not conflict with the cultural vocation and functioning of the Institution.<\/li>\n<\/ol>\n<h4>Article 4 - Funding<\/h4>\n<ol>\n<li>The Conservatoire's sources of funding consist of transfers from the State, grants from public and private entities, and its own revenues; all sources of funding, both public and private, enter into the Conservatoire's budget.<\/li>\n<li>The Conservatoire's own revenue consists of contributions and autonomous forms of financing, such as voluntary contributions, proceeds from activities, income, fruits and disposals of assets, acts of liberality and consideration for contracts and agreements, as well as contributions deriving from the concession of the use of spaces to external parties in accordance with Article 3, paragraph 2 above. For investment expenditure, the Conservatoire may resort, within the limits and under the conditions provided for by the legislation in force, to loans or other forms of financing, in order to ensure that the budget is balanced on a multi-year scale.<\/li>\n<\/ol>\n<\/div><\/div><\/section>\n<section class='av_tab_section av_tab_section av-mhm0zepd-65e1be1ad1c05003a52920352a9d326f'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div id='tab-id-2-tab' class='tab' role='tab' aria-selected=\"false\" tabindex=\"0\" data-fake-id='#tab-id-2' aria-controls='tab-id-2-content'  itemprop=\"headline\" >Title II<\/div><div id='tab-id-2-content' class='tab_content' role='tabpanel' aria-labelledby='tab-id-2-tab' aria-hidden=\"true\"><div class='tab_inner_content invers-color'  itemprop=\"text\" ><h3>Statutory and regulatory autonomy <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/h3>\n<h4>Article 5 - Statute<\/h4>\n<p>This Statute of the Conservatory is adopted pursuant to Presidential Decree no. 132 of 28 February 2003, as amended, and Presidential Decree no. 212 of 8 July 2005.<\/p>\n<h4>Art. 6 - Regulatory Autonomy of the Conservatoire<\/h4>\n<p>The Conservatoire's regulatory autonomy is expressed in the enactment of the Education Regulations, the Administration, Finance and Accounting Regulations, the Regulations for Administrative Offices and internal regulations containing organisational, management and disciplinary provisions.<\/p>\n<h4>Art. 7 - Education Regulations<\/h4>\n<ol>\n<li>The Education Regulations regulate the system of studies on the basis of which the Conservatoire issues qualifications with legal value. It also lists the courses that can be activated in relation to the respective curricula and defines the general rules concerning the courses and training activities envisaged by the Regulation pursuant to letter h), paragraph 7, Article 2 of Law no. 508\/99. It is resolved by the Academic Council by absolute majority, after consulting the Student Council, and adopted by decree of the Director.<\/li>\n<li>The text of the Rules, decided pursuant to the previous paragraph, is sent to the Ministry of Education, Universities and Research, which, having obtained the opinion of the CNAM, exercises control.<\/li>\n<li>The Rules enter into force upon publication on the Institute's notice board.<\/li>\n<li>The revision of the Education Regulations is carried out according to the procedures laid down for approval.<\/li>\n<li>Article 8(3)(d) and Article 14(3) of Presidential Decree No. 132\/03 and Article 10(2) of Presidential Decree No. 212\/05 apply to the approval of the Regulation.<\/li>\n<\/ol>\n<h4>Art. 8 - Administration, finance and accounting regulations<\/h4>\n<ol>\n<li>The Administration, Finance and Accounting Regulations govern the procedures for exercising the administrative, financial and accounting autonomy of the Institute. Deliberated by the Board of Directors by absolute majority, after consultation with the Academic Council, according to a model scheme drawn up by the Ministry of Education, Universities and Research in agreement with the Ministry of the Economy and Finance, they are adopted by decree of the President.<\/li>\n<li>The text of the Rules, resolved pursuant to the preceding paragraphs, is sent to the Ministry of Education, University and Research for approval, in agreement with the Ministry of the Economy and Finance and the Prime Minister's Office, Department of the Civil Service.<\/li>\n<li>The Rules enter into force upon publication on the Institute's notice board.<\/li>\n<li>The revision of the Rules of Administration, Finance and Accounting is carried out according to the same procedures as for approval.<\/li>\n<\/ol>\n<h4>Article 9 - Regulation on the organisation of offices<\/h4>\n<ol>\n<li>The Regulation on Administrative Offices governs the organisation of the offices entrusted with the administrative and accounting management of the institution.<\/li>\n<li>It is resolved, by absolute majority, by the Board of Directors, after hearing the Academic Council, and is forwarded to the Ministry of Education, Universities and Research for approval, in agreement with the Ministry of the Economy and Finance and the Prime Minister's Office - Department of the Civil Service. It is issued by decree of the President.<\/li>\n<li>The regulation comes into force with its publication on the Institute's notice board.<\/li>\n<li>The revision of the Administrative Offices Regulations is carried out according to the approval procedures.<\/li>\n<\/ol>\n<h4>Art. 10 - Internal Regulations<\/h4>\n<ol>\n<li>The regulations of all the structures for the management and organisation of teaching, production and research, as well as those of the Library and the Service Centres, are resolved by the Administrative Board on the basis of the opinion of the Academic Board, and adopted by decree signed jointly by the President and the Director.<\/li>\n<li>The Rules of the Student Council, drawn up and approved by the Council, are adopted by decree signed jointly by the President and the Director, after verifying their compatibility with the reference legislation and the Institution's Statute.<\/li>\n<li>The regulations may not contain provisions that conflict with legal requirements or the Statute of the Institution. In the event of such contradictions, or hypotheses of internal contradictions in the regulations, the relevant texts are referred to the deliberating bodies by an act of the President or the Director.<\/li>\n<\/ol>\n<\/div><\/div><\/section>\n<section class='av_tab_section av_tab_section av-mhm1h9ev-ec07272ed505657b2575a28e767d370f'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div id='tab-id-3-tab' class='tab' role='tab' aria-selected=\"false\" tabindex=\"0\" data-fake-id='#tab-id-3' aria-controls='tab-id-3-content'  itemprop=\"headline\" >Title III<\/div><div id='tab-id-3-content' class='tab_content' role='tabpanel' aria-labelledby='tab-id-3-tab' aria-hidden=\"true\"><div class='tab_inner_content invers-color'  itemprop=\"text\" ><h3>Conservatory Organs <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/h3>\n<h4>Art. 11 - Bodies<\/h4>\n<ol>\n<li>Pursuant to Article 4 of Presidential Decree No. 132\/03, the following are necessary organs of the institution:<br \/>\na) the President<br \/>\n(b) the Director<br \/>\n(c) the Board of Directors<br \/>\nd) the Academic Council<br \/>\ne) the Board of Auditors<br \/>\n(f) the Evaluation Team<br \/>\ng) the College of Professors<br \/>\nh) the Student Council<\/li>\n<li>They are also organs of the institution:<br \/>\n(i) the Technical-administrative staff council<br \/>\n(l) the Disciplinary Board.<\/li>\n<li>All the bodies of the institution, with the exception of the Board of Professors, hold office for three years; individual members of these bodies may only be confirmed consecutively once.<\/li>\n<li>In the event of a loss of the objective requirements for membership of the above-mentioned bodies, appointments or by-elections shall be made as soon as possible in accordance with the specific procedures of each body.<\/li>\n<li>Subject to the incompatibilities enshrined in the law and in the applicable contractual rules:<br \/>\na) the offices of academic advisor, lecturers' representative on the Board of Directors, Department coordinator, member of the Unitary Trade Union Representation (RSU), trade union delegate (association terminal), member of the Disciplinary Committee, member of the Teaching and Research Quality Committee, member of the Evaluation Board are incompatible with each other. Furthermore, the member of the Evaluation Board cannot hold the offices referred to in Article 13, paragraph 9 of these Statutes;<br \/>\nb) Board members may not accept appointments from entities and\/or institutions that have economic relations with the Conservatoire;<br \/>\nc) the positions of Director, member of the Board of Directors and member of the Academic Council are not compatible with management positions in other training or music production institutions, subject to the option;<br \/>\nd) Members of the Academic Council may not take part in voting on resolutions involving themselves personally, or as representatives of external bodies or institutions, or relatives or relatives-in-law up to the third degree.<\/li>\n<\/ol>\n<h4>Art. 12 - President<\/h4>\n<ol>\n<li>The President of the Institution is appointed and performs the functions according to the principles laid down in Article 5 of Presidential Decree No. 132\/03 as amended. The President:<br \/>\na) he is the legal representative of the Institution, except as provided for in Article 6, paragraph 1 of Presidential Decree No. 132\/03; he convenes and chairs the Board of Directors and sets its agenda;<br \/>\nb) is appointed by the Minister from among a trio of individuals, designated by the Academic Council, with high professional and managerial qualifications, as well as proven experience in the management bodies of cultural institutions or with recognised expertise in the artistic and cultural field;<br \/>\nc) issue the decrees concerning the Regulations referred to in Articles 8 and 9 above;<br \/>\nd) promote initiatives aimed at strengthening the Conservatoire's financial endowment; propose cooperation relations with public and private entities, the approval of which is referred, according to their respective competences, to the Academic Council or the Administrative Council;<br \/>\ne) in cases of necessity and urgency, take the necessary measures, which, if they fall within the competence of the Board of Directors, are to be submitted to that body for ratification at the first subsequent useful meeting.<\/li>\n<li>Should the President temporarily cease to hold office for any reason, his powers are exercised ad interim by the Director, with the exception of the chairmanship of the Board of Directors.<\/li>\n<li>The President is competent to authorise the knowledge and\/or the release of copies of the acts of the Board of Directors on the basis of a reasoned written request by any interested parties, in compliance with the rules on confidentiality.<\/li>\n<li>The President, having reviewed the planning of teaching, artistic and research activities drawn up by the Academic Board, the budget plan for activities and purchases prepared by the Library Board, as well as the Director's report, submits an annual report on the Institute's activities and prospects to the Board.<\/li>\n<li>The President is the holder of the authorisations required by current legislation to hold public performances on the Institute's premises, in accordance with Article 3 of these Statutes.<\/li>\n<\/ol>\n<h4>Art. 13 - Director<\/h4>\n<ol>\n<li>Pursuant to Article 6 of Presidential Decree no. 132\/03, the Director is responsible for the educational, scientific and artistic performance of the institution and is its legal representative with regard to collaborations and activities on behalf of third parties concerning teaching, research, experimentation and production. The Director:<br \/>\na) convene and chair the Academic Council;<br \/>\n(b) submit a public report on the state of the institution at the beginning and end of each academic year;<br \/>\nc) take, in case of necessity and urgency, the necessary measures, which, if they fall within the remit of the Academic Council, are to be submitted to that body for ratification at the first subsequent useful meeting;<br \/>\nd) issue the decrees relating to the regulations referred to in Article 10(1) and (2) above.<\/li>\n<li>In the hypothesis of conferring the office \u201cby clear renown\u201d pursuant to Legislative Decree No 297 of 16 April 1994, the Minister shall first obtain the opinion of the Academic Council.<\/li>\n<li>The Director is released from his teaching duties if he so requests.<\/li>\n<li>The Director is granted a management allowance from the Institution's budget.<\/li>\n<li>The Director is elected by the Institution's first- and second-rank teachers, from among the first-rank teachers - also from other Conservatories - who meet specific requirements of proven professionalism established by the regulation pursuant to art. 2, par. 7, letter a) of Law no. 508\/1999. Until the adoption of the aforesaid regulation, the elective office is reserved to first-rank teachers with at least 5 years of service in the rolls and with professional and managerial experience, also acquired in multidisciplinary and international contexts.<\/li>\n<li>The teaching staff elects the Director by secret ballot, on the basis of nominations accompanied by an election programme and curriculum. Nominations must be received by the Directorate at least 20 days before the start of voting and are posted on the Institute's notice board. Voting is called by the incumbent Director at least 60 days before the end of the term of office and is held by secret ballot on three consecutive working days at least five weeks before the same deadline. The candidate with an absolute majority of votes (half plus one of those entitled to vote) is elected. If no candidate achieves this majority, a runoff is held between the two candidates who obtained the highest number of votes in the first round. The runoff shall be held by secret ballot for a period of three consecutive working days, beginning no earlier than seven days after the publication of the result of the first ballot. The candidate obtaining the highest number of votes shall be elected, regardless of the number of voters. In the event of a tie, the candidate with the least seniority shall be deemed the winner.<\/li>\n<li>Within 30 days of assuming office, the Director appoints a Deputy Director to whom he grants power of signature on urgent and due actions. In the event of the temporary absence or impediment of the Director, the Deputy Director takes over from the Director. In the event of the permanent impediment of the Director, or of his resignation, the Vice-Director calls the elections for the new Director according to the above-mentioned procedures. The new Director remains in office until the end of the current three-year period.<\/li>\n<li>The Director may entrust to Conservatoire professors the temporary performance of functions that are not strictly reserved to him, that involve tasks also of institutional representation or are aimed at the realisation of specific projects or the performance of defined activities, after having heard the opinion of the Academic Council and the Administrative Council.<\/li>\n<li>The Director is the holder of disciplinary action against teaching staff and students. This power is exercised with reference to the contractual rules of the teaching staff and to the provisions of the Conservatoire's regulations. Every decision is taken on the basis of the results of the preliminary investigation carried out by the Disciplinary Committee as per Article 19 below. In particularly serious and urgent cases, the Director may intervene with precautionary measures even before the end of the preliminary investigation, pending the final decision.<\/li>\n<\/ol>\n<h4>Article 14 - Academic Council<\/h4>\n<ol>\n<li>The Academic Council, pursuant to Article 8 of Presidential Decree No. 132\/03:<br \/>\na) determines the policy plan and programming of the educational, scientific, artistic and research activities, taking into account the budget availability for the financial year in question;<br \/>\n(b) ensure the monitoring and control of the activities referred to in point (a) also on the basis of the annual report of the Evaluation Board;<br \/>\nc) it defines, with due respect for the autonomy of the teaching, production and research structures, the guidelines for intervention and development of teaching, research and production according to a multiannual programme;<br \/>\nd) decides, in accordance with the general criteria laid down in the Regulation referred to in Article 2(7)(h) of Law No. 508\/99, the teaching regulations referred to in Article 7 of this Statute and, having consulted the Student Council, the student regulations.<br \/>\ne) It exercises the competences relating to the recruitment of teachers provided for in the Regulation referred to in Article 2(7)(e) of Law No. 508\/99;<br \/>\nf) exercise any other function not expressly delegated by these Rules to the Board of Directors.<\/li>\n<li>In order to perform its functions, the Academic Council makes use of special commissions, which are set up by resolution of the Council itself and, as far as it is concerned, of the Administrative Council. Each Commission is chaired by a coordinator appointed by the Academic Council.<\/li>\n<li>Pursuant to Article 8 of Presidential Decree No. 132\/03, the Academic Council consists of thirteen members: the Director, who presides over it; ten lecturers of the Institution elected by the teaching staff from among the professors with permanent appointments who have not less than two years' seniority at the institution; and two students elected in accordance with the procedures set out in the Student Council Regulations.<\/li>\n<li>The elections are called, subject to later fixing of the voting date, by the Director whose term is about to expire. The representatives of the teaching staff are elected on the basis of candidatures with attached curriculum vitae, which, under penalty of ineligibility, must reach the Directorate within seven days of the proclaimed election of the new Director, to be posted without delay on the Institute's notice board. Pre-election meetings may be held up to the eve of voting. Voting operations, by secret ballot, take place on three consecutive days not earlier than fifteen days after the proclamation of the newly-elected Director, who fixes the calendar and timetable and ensures that it is posted on the Institute's notice board.<\/li>\n<li>If, due to resignation or other cause, any of the members is no longer available, the Director calls by-elections to reintegrate the numerical composition of the Board. The newly elected members remain in office until the end of the three-year period from the constitution of the body.<\/li>\n<li>The Academic Council, for the purpose of appointing the President, in accordance with the criteria set out in Article 12(1)(b) of this Statute, shall designate the trio to be proposed to the Minister.<\/li>\n<li>The Academic Council appoints the Lecturer to the Board.<\/li>\n<li>The Academic Council decides on the allocation of tasks for the management of the teaching, artistic, research and production structures on the basis of indications from the structures themselves.<\/li>\n<li>The Academic Council, on the basis of the needs expressed by the teaching structures, provides for the allocation of teaching assignments, aiming at the best use of the resources and skills present in the teaching staff.<\/li>\n<\/ol>\n<h4>Article 15 - Board of Directors<\/h4>\n<ol>\n<li>The Board of Directors, pursuant to Article 7 of Presidential Decree No. 132\/03, is composed as follows:<br \/>\na) the President of the Conservatory, who is an ex officio member, who chairs it;<br \/>\n(b) the Director, ex officio member;<br \/>\nc) one lecturer of the institution, in addition to the Director, designated by the Academic Council;<br \/>\nd) one student designated by the Student Council;<br \/>\ne) one administrative expert, appointed by the Minister, chosen from personalities from the world of art and culture, the productive and social system, the professions and public and private bodies;<br \/>\nf) additional members, up to a maximum of two, appointed by the Minister on the nomination of bodies, including territorial bodies, foundations or public or private cultural, artistic or scientific organisations, if the aforesaid entities contribute to the financing or operation of the Institution for a share of not less than that established by decree of the Minister.<\/li>\n<li>If, due to resignation or other cause, any of the members envisaged in sub-paragraphs c) and d) of the preceding paragraph cease to be present, they shall be replaced in the same manner as above.<\/li>\n<li>The Board of Directors, in implementing the lines of intervention and development of teaching, research and production defined by the Academic Council, establishes the objectives and programmes of administrative management and promotes initiatives aimed at strengthening the institution's financial endowments. In particular:<br \/>\na) after consultation with the Academic Council, approve the Statutes and regulations referred to in Articles 8, 9 and 10 above;<br \/>\nb) defines, in implementation of the policy plan referred to in Article 8(3)(a) of Presidential Decree No 132\/03, the programming of the institution's economic management;<br \/>\n(c) approve the budget, its variations, and the final accounts;<br \/>\nd) it defines, within the limits of the budget availability and in compliance with contractual regulations, the number of teaching and non-teaching staff. For teaching staff it acquires the proposals of the Academic Council. For non-teaching staff, it acquires the opinion of a special commission, chaired by the Administrative Director and formed by a representative appointed by the Technical-administrative staff Council;<br \/>\ne) oversee the preservation and enhancement of the Institution's real estate and movable heritage, including the Library and the collection of historical musical instruments, taking into account the teaching, scientific and research needs deriving from the policy plan determined by the Academic Council;<br \/>\nf) decides on the conservation, restoration and valorisation of musical instruments of particular historical and organological value that belong to the Conservatoire's patrimony, based on the work of the Commission referred to in Article 25, paragraph 2. The Board decides on the granting of possible loans, possible against special guarantees and particular didactic and artistic benefits, as well as on their exhibition to the public;<br \/>\ng) decides, in line with the development plans and according to the priorities indicated by the Academic Council, on the allocation of building resources and the use of space by third parties;<br \/>\nh) determines, after consulting the Academic Council and the Student Council, the amount of the fees to be paid by the students;<br \/>\ni) ensure the means necessary for the performance of the functions and activities of the Student Council;<br \/>\nl) decides on any transformation of the movable and immovable assets of the Institute, including the acceptance of bequests and donations.<\/li>\n<li>The Board of Directors is convened by the President on his own initiative or at the request of at least one third of its members without any formal obligations, provided that suitable means are forwarded to those entitled to attend at least ten days prior to the date set for the meeting; in the event of necessity or urgency, notice may be given three days prior to the set date. The convocation notice must contain the agenda of the meeting, the place and time. The Board of Directors meets validly with the presence of the majority of the Board members. Resolutions are passed with the favourable vote of the majority of those present. In the event of a tie, the vote cast by the President prevails. Meetings are chaired by the President or in the event of his absence or impediment by the Vice-President. In the event that the Vice-President is also absent, the meeting shall be adjourned to the first useful date. Minutes of the meetings are drawn up, signed by the person chairing the meeting and the secretary. The Administrative Director participates in the Board of Directors in an advisory capacity and acts as a minute taker. If he is unable to attend, the Administrative Director delegates a trusted employee to represent him.<\/li>\n<li>The competence of the Board of Directors with regard to the best management and increase of assets and financial resources is aimed at the extension and qualification of the educational offer and the related artistic and research production, according to multi-year programmes.<\/li>\n<li>At its first meeting, the Council appoints a Vice-President from among its members, who, in the absence or impediment of the President, performs his functions within the body.<\/li>\n<li>If the Board of Directors is not reconstituted in a timely manner after its expiry, the ordinary administration of the Conservatory is provisionally managed by the President.<\/li>\n<li>The councillors appointed after the composition of the Council remain in office until the expiry of the entire body.<\/li>\n<\/ol>\n<h4>Article 16 - College of Professors<\/h4>\n<ol>\n<li>Pursuant to Article 11 of Presidential Decree No. 132\/03, the Board of Professors:<br \/>\na) it is composed of the Director, who chairs it, and all first and second-rank lecturers serving the Institution;<br \/>\nb) performs a support function for the activities of the Academic Council, helping to determine the general objectives and guidelines;<br \/>\nc) deliver opinions and make requests concerning the two annual reports submitted by the Director, as well as the revision of the Statute and Regulations.<\/li>\n<li>The Board of Professors is convened by the Director and, on specific issues, as often as requested by half plus one of the members of the Academic Council, or by one third of the members of the Board.<\/li>\n<\/ol>\n<h4>Article 17 - Board of Auditors<\/h4>\n<ol>\n<li>Pursuant to Article 9 of Presidential Decree No. 132\/03, the Board of Auditors, established by order of the President, is made up of three members, one of whom, who chairs it, is designated by the Minister of Economy and Finance, and two designated by the Minister of University and Research.<\/li>\n<li>The members must meet the requirements of Legislative Decree No. 88 of 27 January 1992.<\/li>\n<li>The Board of Auditors supervises the legitimacy, regularity and fairness of administrative action; it performs the administrative and accounting regularity checks referred to in Article 2 of Decree-Law No. 286 of 30 July 1999; the provisions of the Civil Code apply to it insofar as they are compatible.<\/li>\n<\/ol>\n<h4>Article 18 - Evaluation team<\/h4>\n<ol>\n<li>Pursuant to Article 10 of Presidential Decree No. 132\/03, the Evaluation Board, established by resolution of the Board of Directors, is composed of three members with differentiated competences, appointed jointly by the Academic Council and the Board of Directors: one lecturer who is not a member of the Institution's governing bodies and two external members, including foreigners, with proven qualifications in the field of evaluation.<\/li>\n<li>The appointment of the Evaluation Board takes place within 30 days from the date of installation of the Board of Directors. The appointment is valid for three years with the possibility of consecutive renewal for another three-year period only.<\/li>\n<li>The Evaluation Board verifies that the results correspond to the objectives. In particular:<br \/>\na) is responsible for evaluating the results of teaching and scientific activities and the overall functioning of the institution, verifying, also by means of comparative cost and performance analyses, the optimal use of resources, including administrative and technical resources;<br \/>\nb) draw up an annual report on the activities and functioning of the Institution on the basis of general criteria determined by the National Committee for the Evaluation of the University System, having consulted the CNAM. The report is sent to the Ministry by 31 March each year and constitutes the reference framework for the allocation of financial contributions by the Ministry;<br \/>\nc) periodically acquires, while preserving anonymity, the students' opinions on teaching activities, giving an account of them in the annual report referred to in point b).<\/li>\n<li>The Conservatoire grants the Evaluation Board operational autonomy, the right of access to the necessary data and information, as well as the publicity and dissemination of the acts in compliance with the regulations protecting confidentiality.<\/li>\n<\/ol>\n<h4>Art. 19 - Disciplinary Committee<\/h4>\n<ol>\n<li>The Disciplinary Committee is responsible for investigating disciplinary proceedings. For proceedings against lecturers, the Commission consists of three lecturers appointed by the Academic Council. In the case of proceedings against a student, the aforementioned Committee is supplemented by two students appointed by the Student Council. In the case of proceedings against a member of the technical-administrative staff, the Commission consists of three representatives appointed by the staff council. The results of the investigation are a condition for the continuation of disciplinary proceedings, except in cases of particular urgency and seriousness that require immediate precautionary measures.<\/li>\n<li>The same Commission in its three configurations, or jointly if necessary, acts as an Honour Jury to which lecturers, students and administrative technical staff may appeal if they feel their honour has been compromised.<\/li>\n<\/ol>\n<h4>Article 20 - Student Council<\/h4>\n<ol>\n<li>Pursuant to Article 12 of Presidential Decree No. 132\/03, the Student Council, in addition to expressing opinions as provided for by the Statute and regulations, may address requests and make proposals to the Academic Council and the Administrative Council with particular reference to the organisation of teaching and student services.<\/li>\n<li>The Council consists of seven representatives, plus the two students elected to the Academic Council. The passive electorate is made up of students over the age of 18 and the active electorate is made up of students aged 16 and over. Any increase or decrease in the number of students constituting the electoral base of the Consulta entails - when voting for its renewal - a corresponding change in the number of representatives in accordance with Article 12 of Presidential Decree no. 132\/03.<\/li>\n<li>All members of the Council are elected by the students by secret ballot on the basis of nominations communicated to the Directorate at least 10 days before the start of voting. The elections are called by the Director at least 20 days before the start of voting, which will take place over a period of 3 working days.<\/li>\n<li>The procedures for appointing the student representative to the Board of Directors and for electing the two representatives to the Academic Council and the representatives to any other management body for teaching, production, research and service activities are set out in the Student Council Regulations.<\/li>\n<li>The Student Council draws up the plan for the possible funding of activities proposed to the Academic Council and the Board of Directors in accordance with their respective competences; this plan must be submitted to the Board of Directors in time for the approval of the annual budget.<\/li>\n<li>Each student elected to the Council has a three-year term of office, subject to the provisions of Article 11(4) of this Statute, renewable consecutively once. Every year, elections are held by 30 November to fill any vacancies in the Council.<\/li>\n<\/ol>\n<h4>Article 21 - Technical-administrative staff council<\/h4>\n<ol>\n<li>The Council has a propositional and advisory function vis-\u00e0-vis the Academic Council and the Administrative Council.<\/li>\n<li>The Council is composed of the Administrative Director, who chairs it and convenes it at least twice a year, two representatives elected by the administrative staff from among its members and four representatives elected by the technical staff from among its members.<\/li>\n<li>The council expresses opinions and makes proposals:<br \/>\n(a) on specific issues concerning technical-administrative activities;<br \/>\n(b) on regulations in the parts concerning technical-administrative staff;<br \/>\n(c) on the establishment plan for technical-administrative staff.<\/li>\n<\/ol>\n<\/div><\/div><\/section>\n<section class='av_tab_section av_tab_section av-mhm1ir9a-8a2f28f29dfb2c4ad8aa0379056d8d52'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div id='tab-id-4-tab' class='tab' role='tab' aria-selected=\"false\" tabindex=\"0\" data-fake-id='#tab-id-4' aria-controls='tab-id-4-content'  itemprop=\"headline\" >Title IV<\/div><div id='tab-id-4-content' class='tab_content' role='tabpanel' aria-labelledby='tab-id-4-tab' aria-hidden=\"true\"><div class='tab_inner_content invers-color'  itemprop=\"text\" ><h3>Facilities for teaching, production and research <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/h3>\n<h4>Art. 22 - Educational offer<\/h4>\n<ol>\n<li>The structures for teaching, production and research, established in accordance with the dictates of Presidential Decree no. 212\/05, are an integral part of the Conservatoire's educational offer and are the primary seat of its elaboration and planning, without prejudice to the prerogatives of the Academic Council.<\/li>\n<li>The nature, number and tasks of these structures are subject to determination by the Conservatoire's didactic regulations.<\/li>\n<li>The Administrative Council allocates space and financial resources to all these bodies within the limits of the budget and within the rules of the Regulation for Administration, Finance and Accounting.<\/li>\n<li>The management bodies of the structures referred to in paragraph 1 have a three-year term and their coordinators or contact persons may only be re-elected consecutively once.<\/li>\n<\/ol>\n<h4>Article 23 - Commission for the Quality of Teaching and Research<\/h4>\n<ol>\n<li>The Commission for the Quality of Teaching and Research is established in an advisory capacity by the Academic Council pursuant to Article 14(2) of these Statutes.<\/li>\n<li>Its tasks are :<br \/>\na) propose a constant evolution and updating of the training offer in line with international standards of excellence and the requirements for access to national and international funding programmes;<br \/>\nb) activate international comparison procedures with similar institutions;<br \/>\nc) verify, in consultation with the Evaluation Board referred to in Article 18, the evaluations expressed by students on the organisation and functionality of the teaching provided.<\/li>\n<li>The Commission, appointed by the Academic Council, consists of internal lecturers and at least two external lecturers chosen from experts in education and culture management.<\/li>\n<\/ol>\n<\/div><\/div><\/section>\n<section class='av_tab_section av_tab_section av-mhm1jz33-a20466594a93464401b062e52ed3d52b'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div id='tab-id-5-tab' class='tab' role='tab' aria-selected=\"false\" tabindex=\"0\" data-fake-id='#tab-id-5' aria-controls='tab-id-5-content'  itemprop=\"headline\" >Title V<\/div><div id='tab-id-5-content' class='tab_content' role='tabpanel' aria-labelledby='tab-id-5-tab' aria-hidden=\"true\"><div class='tab_inner_content invers-color'  itemprop=\"text\" ><h3>Service facilities <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/h3>\n<h4>Article 24 - Library<\/h4>\n<ol>\n<li>The Milan Conservatory of Music is responsible for the conservation, management and valorisation of the extensive heritage of its Library, which, in addition to its function as a facility available to the Institute's teaching, research and production activities, performs a cultural service in the interest of the national and international community of musicologists, historians and scholars in general. The Librarian and the Library Council are responsible for the operation of the Library.<\/li>\n<li>In order to achieve the purposes set out in paragraph 1. above, the Board of Directors shall identify suitable premises and adequate instrumental and financial resources.<\/li>\n<li>The ex officio members of the Library Board are the Director, who chairs it, and the Librarian. Also members are one member appointed by the Board of Directors, one member appointed by the Academic Council and one student appointed by the Student Council. The Library Board, upon indication of the Librarian, may propose to the Academic Council the co-opting of another member, chosen among scholars of recognised value, even from outside the Conservatory. Pursuant to Article 10, paragraph 1 of these Articles of Association, the Library Board prepares the Library Regulations, which are deliberated and adopted in the manner set forth in Article 10, paragraph 1.<\/li>\n<li>The Library Board determines a preliminary plan of activities and purchases, forwarding the request for the corresponding resources to the Administrative Council. They may concern: the right to study; national and international mobility of teachers and students; computer, statistical, telematic, multimedia, printing and publishing services; communication and public relations services; production support services and any other services that may be required.<\/li>\n<li>The procedures for the establishment, organisation and operation of the service centres are laid down and governed by special regulations adopted by the Board of Directors in agreement with the Academic Council pursuant to Article 10(1).<\/li>\n<li>Service centres may be set up as consortia with other institutions and public or private entities.<\/li>\n<\/ol>\n<h4>Art. 27 - Administrative Director<\/h4>\n<ol>\n<li>Pursuant to Article 13 of Presidential Decree no. 132\/03, the Administrative Director is responsible for the organisational, financial, administrative, patrimonial and accounting management of the Institution within the framework of the directives formulated by the Board of Directors and in compliance with its resolutions.<\/li>\n<li>The Administrative Director heads the offices and ensures their smooth running. He or she directs, manages and supervises the technical administrative staff and ensures that they are constantly updated.<\/li>\n<li>The Administrative Director regularly updates the Board of Directors on the financial and cash situation. codes for administrative, technical and teaching staff of the Afam Institutions, ex CCNL of the Education and Research sector signed on 19 April 2018.<\/a><\/p>\n<p>With reference to the\u00a0<strong>obligations and disciplinary responsibility of the technical and administrative staff of the Afam institutions,\u00a0<\/strong>are particularly noteworthy:<\/p>\n<ol>\n<li><em>The obligation to observe working hours and fulfil the formalities for recording attendance; not to be absent from the workplace without the authorisation of the manager or supervisor; (Art. 11(3)(e));<\/em><\/li>\n<li><em>the obligation not to introduce, without due authorisation, persons from outside the administration into premises not open to the public (Art. 11(3)(m)); ;<\/em><\/li>\n<li><em>the obligation to inform the administration of one's residence and, where this does not coincide, one's temporary abode, as well as any subsequent change thereof (Art. 11(3)(n));<\/em><\/li>\n<li><em>the obligation to give timely notice to the office to which one belongs in the event of illness (Art. 11(3)(0));<\/em><\/li>\n<li><em>the obligation to inform the administration of the existence of committals for trial in criminal proceedings (Art. 11(3)(q)).<\/em><\/li>\n<\/ol>\n<p>With reference to the\u00a0<strong>obligations of teaching staff<\/strong>\u00a0Article 100, paragraph 1, and in particular the provisions of subparagraphs:<\/p>\n<p><em>(d) respect working hours and fulfil the formalities required to record attendance and perform the duties associated with teaching and teaching-related activities;<\/em><br \/>\n<em>e) during working hours, maintain, in interpersonal and user relations, a conduct that is not only in line with general principles of fairness but also with the need for consistency with the specific educational purposes of the entire academic community, refraining from conduct detrimental to the dignity of other employees, users and pupils;<\/em><br \/>\n<em>(f) maintain a conduct consistent with the educational aims of the academic community in relations with families, male and female students;<\/em><br \/>\n<em>(g) limit interaction via social computer channels with students to service information and interactions necessary for the performance of the education, instruction and guidance function;<\/em><br \/>\n<em>h) comply with the duties of supervision towards pupils, students and students, without prejudice to the instructions given;<\/em><br \/>\n<em>(i) keep the records and other forms of documentation required by specific provisions in force for each job profile;<\/em><br \/>\n<em>j) fulfil the obligations related to the performance of his duties and educational activities, also by ensuring his participation in the meetings of the bodies of the institutions and educational structures to which he belongs;<\/em><br \/>\n<em>(k) ensure participation in the work
